Op Tracker™Privacy Statement
Lim GeomaticsInc. (“LGI”) has created this privacy statement (“Statement”) to set out how LGI collects, uses, and discloses the personal information collected by the Op Tracker™ (the “Software”). Op Tracker™ is a mobile GIS application for tablets designed to track the location of equipment in relation to defined boundaries and areas in both a “disconnected editing” mode for offline use and network connected mode with data synchronization support. Op Tracker™ allows users to monitor and quantify equipment performance and productivity using location data. Your privacy is of great importance to LGI. By visiting LGI’s website located at http://www.limgeomatics.com (the “Website”) or using the Software in any manner, you acknowledge that you accept the practices and policies outlined in this Statement and you hereby consent to the collection, use and disclosure of your personal information in accordance with this Statement.
1. WHAT DOES THIS STATEMENT COVER?
This Statement covers LGI’s collection, use and disclosure of information about an identifiable individual (“Personal Information”). This Statement does not apply to the practices of companies that LGI does not own or control, or to individuals that LGI does not employ or manage. LGI does not knowingly collect or solicit Personal Information from anyone under the age of 18 or knowingly allow such persons to register to use the Software.
2. COLLECTION OF PERSONAL INFORMATION
2.1. Esri Account Information
To use LGI’s Software, users must have a valid Esri Named User account which can be used to log in to the Software. When you use the Software, LGI does not collect or store your Esri account username and password as the authentication and authorization process is handled by Esri. Your use of an Esri account is governed by Esri’s Terms of Service, Privacy Statement, and any other applicable documents.
2.2. Op Tracker™ Performance and Productivity Data
Op Tracker™ collects location and accelerometer data (“Data”) from the tablet installed in an individual’s machinery (“End User”). While the data collected may be linked to the End User operating the machinery, LGI do not collect the names or identity of any End Users. The Data collected are stored in the End User’s ArcGIS Online account, but are shared with LGI with control over what Data are shared set by the End User.
2.3. Usage Data
LGI may also collect certain information about End Users of LGI’s Website and Software, such as Internet addresses, time spent logged into the Software and other usage data. This information is logged to help diagnose technical problems, and to administer our Website and update our Software to constantly improve the quality of LGI’s products and services.
Technologies such as cookies, beacons, scripts and tags are used by us and our third-party partners. These technologies are used in analyzing trends, administering the website, tracking users’ movements around the website, and gathering demographic information about our user base as a whole. LGI may receive reports based on the use of these technologies by these companies on an individual and aggregated basis. Various browsers may offer their own management tools for removing these types of tracking technologies.
Standing alone, cookies do not identify you personally, but merely recognize your browser. There are two types of cookies and these include: session and persistent-based. Session cookies exist only during an online session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you have closed your browser or turned off your computer. They include such information as a unique identifier for your browser.
LGI uses session cookies containing encrypted information to allow the system to uniquely identify you while you are logged in. This information allows LGI to process your online transactions and requests. Session cookies help us make sure you are who you say you are after you have logged in and are required in order to use the LGI Software.
Our third-party partners also employ clear gifs (i.e., Web Beacons and Web Bugs), images, and scripts that help them better manage content on LGI’s Website. LGI does not tie the information gathered to End User personal information.
3. USE OF PERSONAL INFORMATION
LGI uses the Personal Information that the company collects to provide the Software and to continuously improve the Software.
4. STORAGE LOCATION AND TRANSFER OF PERSONAL INFORMATION
LGI stores its data, including Personal Information, on servers located in Canada and the United States. By submitting information, you agree to this transfer, storing or processing of your Personal Information in Canada and the U.S. You acknowledge and agree that your Personal Information may be accessible to law enforcement and governmental agencies in those countries under lawful access regimes or court order.
5. DISCLOSURE OF PERSONAL INFORMATION WITH THIRD PARTIES
5.1. Service Providers and Business Partners
LGI may from time to time employ other companies and people to perform tasks on our behalf and need to share your information with them to provide the Software to you. Unless LGI tells you differently, such third-parties do not have any right to use the Personal Information LGI shares with them beyond what is necessary to assist us. This includes third-party companies and individuals employed by LGI to facilitate our Software, including the provision of maintenance services, database management, web analytics and general improvement of the Software, and businesses who engage LGI’s Software (to the extent provided for above).
5.2. Business Transfers
If LGI (or substantially all of our assets) are acquired, or if LGI goes out of business, enters bankruptcy, or goes through some other change of control, Personal Information may be made available or otherwise transferred to the new controlling entity, where permitted under applicable law.
5.3. With Your Consent
If LGI needs to use or disclose any Personal Information in a way not identified in this Privacy Statement, LGI will notify you and/or obtain your express consent as required under applicable privacy laws.
LGI will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of LGI’s relationship with you. LGI may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Statement.
7. ACCESS, CORRECTION AND ACCURACY
You have the right to access the Personal Information LGI holds about you to verify the Personal Information LGI has collected in respect to you and to have a general account of LGI’s uses of that information. Upon receipt of your written request, LGI will provide you with a copy of your Personal Information, although in certain limited circumstances, LGI may not be able to make all relevant information available to you such as where that information also pertains to another user. In such circumstances, LGI will provide reasons for the denial to you upon request. LGI will endeavor to deal with all requests for access and modifications in a timely manner.
LGI will make every reasonable effort to keep your Personal Information accurate and up to date, and LGI will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which LGI are permitted to disclose your information. Having accurate Personal Information about you enables LGI to give you the best possible service.
8. CHANGES TO THIS STATEMENT
LGI may amend this Statement from time to time. Use of Personal Information LGI collects is subject to the Statement in effect at the time such information is collected, used or disclosed. If LGI makes material changes or changes in the way the company uses Personal Information, LGI will notify you by posting an announcement on our Website or sending you an e-mail prior to the change becoming effective. You are bound by any changes to the Statement when you use the Website after such changes have been first posted.
